V případě, že je tento e-mail součástí jednání o smlouvě, má odesílatel právo ukončit kdykoliv takové jednání i bez uvedení důvodu, například pokud nebudou získána potřebná interní schválení, přičemž příslušná smlouva bude uzavřena teprve výslovným dosažením dohody o celém jejím obsahu. Veškeré informace, jež nejsou veřejně dostupné, poskytnuté odesílatelem při vyjednávání o smlouvě, jsou považovány za důvěrné, pokud odesílatel neprohlásí jinak; v případě, že nedojde k uzavření zamýšlené smlouvy, dohody či jiného ujednání, druhá strana takové informace jí poskytnuté nejen nezveřejní, ale neprodleně vrátí či zničí. Odesílatel neodpovídá za možné vzniklé škody způsobené neúplným přenosem, možnou modifikací či zpožděním této zprávy během přenosu od odesílatele k adresátovi, ani za jakékoli škody, které si adresát způsobí napadením svého systému počítačovým virem nebo jinak škodlivým počítačovým programem.“
